Changing Your Mind - Can You Switch Your Residence Permit from Business to Employment after Arriving?
Many foreigners come to the country on a temporary residence permit in Slovakia for business purposes. They plan to work as entrepreneurs or start a company.
After moving here, their plans may change. They might receive a job offer, their goals may shift, or the business may prove less profitable. In such a situation, the question arises: Is it possible to switch from a business residence permit to an employment residence permit without leaving the country? The answer depends on the rules and grounds for residence.
Who Can Apply for a Change of Residence Purpose?
Foreign nationals with a temporary residence permit may change the purpose of their stay. This is possible if they meet the requirements for the new basis. However, an entrepreneur may switch to a work residence permit after obtaining an employment contract.
This involves filing a new application, not amending the old permit. While the application is being processed, the individual has the right to remain in the country as long as their current residence permit is still valid.
Only those who meet the following criteria may apply:
- holds a valid residence permit;
- complies with the conditions of stay;
- meets the requirements for the new type of residence permit;
- submits a complete set of documents.
There is a restriction on entrepreneurial activities. You may submit an application only 24 months after receiving your current permit.
When switching from self-employment to employment, there is no such waiting period. However, the applicant must submit a new application and meet all the requirements for a work-based residence permit.
